Terms of service

Last updated 28 September 2026

These terms apply to Alvand AI, software operated by Alvand Consulting LLC. Using the product means agreeing to them. They are written to be read, so if something here is unclear, ask before agreeing rather than after.

The account

An account belongs to a business, and the person who opens it confirms they may bind that business. Seats can be added and removed by an owner. Whoever holds a seat acts on behalf of the business, and the business is responsible for what they do with it.

Keep sign in details private. Tell us promptly if you believe an account has been reached by somebody who should not have it.

What you may not do with it

  • Send messages to people who have not agreed to receive them.
  • Continue messaging somebody after they have asked you to stop.
  • Impersonate another person or business, or misrepresent who a message is from.
  • Use it for anything unlawful, or to harass, defraud or deceive.
  • Attempt to reach another business’s data, or to work around the separation between accounts.
  • Resell access without a written agreement to do so.

Messaging, which is the part that matters

Text messaging and Instagram messaging are governed by carrier rules and by Meta’s platform terms, and both are stricter than general law. You are responsible for having permission to message every person you message.

A reply of STOP ends messaging to that number immediately and permanently unless the person opts back in. This is enforced by the software and cannot be turned off. Do not attempt to work around it.

Registration details you supply for carrier approval, including your business name, address and tax identification number, must be accurate. A registration built on inaccurate details is rejected by the carriers and can result in the number being suspended.

AI features

Where you turn on AI drafting or the AI setter, the software generates message text on your behalf. It can be wrong. You remain responsible for everything sent from your account, whether a person typed it or a model drafted it, which is why every AI feature in the product can be paused and every conversation can be taken over by a human at any moment.

Your content and your data

What you upload and what your customers send you remains yours. Alvand holds it only to run the service for you and for the counted learning described in the next section, and uses it for no other purpose. You can export it, and you can have it deleted. See the privacy policy for the detail.

The software itself, its design and its code remain the property of Alvand Consulting LLC.

Learning across accounts

The software learns what tends to work in each kind of business: which shapes of headline turn visits into leads, which kinds of offer turn leads into booked calls, how far ahead calls are booked, how fast replies go out, which kinds of content bring leads, how many follow ups a booking takes, which objections deals are lost on, and which changes people make to the words on pages it built. It uses that when it builds for the next business. It learns from counts taken across every account that has not turned this off. What passes between accounts is a count or a short change of wording, never your copy, your customers, your leads, your answers, your brand or your offer.

  • A count is kept only when at least five separate businesses stand behind it, and none can be identified from it.
  • A change you make to the words on a page becomes a starting point for other accounts only when enough separate businesses made exactly the same change, and never when it holds a price, a number, a link, an address or a business name.
  • Your own corrections always come before any starting point learned this way.
  • An agency and the client accounts it opened count as one business, so no agency sets the words every other account starts from.

You can stop your account being counted at any time from within the product. You still receive what other businesses contributed.

Payments and fees

Where a plan or usage based charge applies, it is billed as described at the time of purchase. Charges already incurred are not refunded on cancellation, and service continues to the end of a period already paid for. Amounts owed to third parties, such as carrier fees for phone numbers and messages, are passed through as billed.

Taking payments from your own customers

When you take payments from your own customers through Alvand AI, these terms apply in addition to everything above. You accept them, and the version you accepted is recorded, before your payment account is opened. This is version 2026-09-30.

Alvand AI takes 1.5% of every payment you process. The fee comes out of what you receive. It is never added to what your customer pays, and your customer never sees it. You see it on every payment as its own line, so what you were paid and what arrived are never two numbers you have to reconcile yourself. It applies to this account and to every sub account under it.

Stripe’s own processing cost comes out of what you receive too. Stripe charges a processing fee on every payment. Like the 1.5%, it is taken from your side of the payment and your customer never pays it. When a payment goes through, an allowance for processing costs is held back. Any excess difference comes back to you after Stripe reports its fee and the adjustment succeeds. If the allowance is too small, the remaining processing cost is deducted from your side. The payment shows the processing fee once it is known and marks pending adjustments. Bank payouts follow Stripe’s own timing and account status. Stripe keeps its fee on a refunded payment.

The 1.5% is kept when you refund a customer. If you refund a payment, your customer gets back everything they paid. Alvand AI does not return its fee on that payment. The whole refund comes out of your balance, so a refunded sale costs you the fee as well as the sale. This is the opposite of what people usually assume, which is why it is stated here rather than left in a help page.

Payouts are held until Stripe finishes verifying you. Payments start only when Stripe enables charges for this account. Payments and bank payouts can be enabled or restricted separately while Stripe checks your details. If payouts are disabled, collected money stays at Stripe until Stripe permits a payout. Stripe’s rules decide when funds can be released. Alvand AI is not holding your money and cannot release it. Follow the secure setup or support steps on your Payments screen and check Stripe’s latest status. Completing a form does not guarantee approval.

Money goes to your own bank on Stripe’s schedule. Payouts run on Stripe’s standard schedule straight to the bank account you gave Stripe. Alvand AI never holds your funds and never runs a payout schedule of its own. If this is a sub account, the money goes to this account’s bank, not to the agency that opened it.

You handle chargebacks, and Stripe takes them from your balance. If one of your customers disputes a payment, you respond to it. Stripe takes the disputed amount out of your balance while it is open. Alvand AI is told about every dispute on your account and can step in to help, but the response is yours and the deadline is Stripe’s.

You are the merchant of record. You sell to your customers, you set your prices, you deliver what you sold, and you are responsible for it. Alvand AI processes the payment and takes its fee. It is not a party to the sale.

If you refund a customer, they get back everything they paid and Alvand AI keeps its 1.5% fee on that payment. The whole refund comes out of your balance.

Availability

The service is provided as it is. Reasonable effort goes into keeping it running and into keeping backups, and no uptime figure is promised here, because a number nobody measures against is not a commitment. Planned work that will interrupt service is announced in advance where possible.

Ending it

You can close an account at any time. Alvand may suspend or close an account that breaks these terms, that creates legal risk for the platform or its other customers, or that has not paid what it owes. On closure you have 30 days to export your data, after which it is deleted.

Liability

To the extent the law allows, Alvand Consulting LLC is not liable for indirect or consequential loss, and total liability is limited to the amount paid for the service in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

Changes and governing law

These terms may change; the date at the top changes with them, and a material change is announced inside the product before it takes effect. These terms are governed by the law of the State of Texas.
